Terms of Use – IndyDTF

These Terms of Use (“Terms”) govern your access to and use of indydtf.com and the products, design tools, DTF transfer services, custom apparel services, account features, and related services offered by Indy DTF LLC (“Company,” “we,” “our,” or “us”).

By using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place orders or use paid Services. By using the Services, you represent that you have authority to enter into these Terms.

2. Accounts

You may need an account to access certain features. You agree to provide accurate information, keep your login credentials secure, and promptly update account, billing, and shipping information when needed. You are responsible for activity under your account.

3. Orders

By placing an order, you agree that all order details, artwork, sizes, quantities, shipping information, and payment information are accurate. We may refuse, cancel, or limit orders for reasons including suspected fraud, unavailable products, pricing errors, production concerns, or violation of these Terms.

4. Artwork and User Content

You retain ownership of artwork and content you upload. You are solely responsible for confirming that you have the right to use, reproduce, and submit that content for printing.

You agree not to upload content that infringes intellectual property rights, violates privacy or publicity rights, is unlawful, harmful, abusive, or otherwise inappropriate.

You grant Indy DTF LLC a limited license to use, reproduce, modify, process, and store uploaded content solely as needed to operate the Services, fulfill orders, support customers, maintain records, and improve production workflows.

5. Custom Printing

Many products are custom-made based on customer-provided artwork and selections. You acknowledge that:

What you upload and approve may be printed

Print color may vary from screen color

Low-resolution or incorrect files may affect final quality
Sizing, spelling, placement, and artwork setup are your responsibility

We are not required to proofread, correct, redraw, or modify artwork unless specifically agreed in writing

6. Pricing and Payments

Prices, product availability, shipping rates, and production options may change without notice. Payments are processed by third-party providers. We do not store full payment card details.

7. Production and Shipping

Production and shipping estimates are not guarantees. Delays may occur due to order volume, artwork issues, supply availability, carrier delays, weather, incorrect addresses, or other circumstances outside our control.

8. Refunds and Returns

Refunds, returns, reprints, and order issue handling are governed by our Refund & Returns Policy and Shipping & Production Policy. Custom orders are generally final unless there is an approved production defect, damage, or error caused by us.

9. Intellectual Property

The website, brand elements, text, graphics, software, design tools, and other materials provided by Indy DTF LLC are owned by us or our licensors and protected by applicable law. You may not copy, reproduce, distribute, or misuse our content without permission.

10. Prohibited Use

You agree not to misuse the Services, interfere with website operation, attempt unauthorized access, upload harmful code, scrape data without permission, commit fraud, or use the Services in violation of law.

11. Disclaimers

The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free operation, exact color matching, or that every product will meet subjective expectations.

12. Limitation of Liability

To the fullest extent permitted by law, Indy DTF LLC is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Services, products, delays, third-party services, or customer-provided content.
